Our firm has handled numerous lawsuits against bar owners who have overserved drunk customers knowing the customer would likely soon be driving. This month, the Georgia Supreme Court rendered a positive ruling for the victims of these crimes.

When people are injured by drunk drivers in Georgia, the biggest challenge is often finding enough insurance to pay for the victim’s medical bills. These cases are brought in Georgia under the Dramshop Act, “dramshop” being a Little House on the Prairie era term for bar. Bars are the typical target but the laws also apply to any business selling alcohol to people who appear intoxicated and will likely soon be driving. On Friday, Georgia’s new bicycle safety law, which requires cars to give three feet of space when passing bikes, went into effect. With this new law hopefully driver’s awareness and respect for bike riders will increase, leading to fewer crashes. HB 101 was announced across the state by a number of bike rider support groups and the local news stations are doing a great job in getting out the word. When I used to commute down Peachtree Street in the late 90s, I was hit by more than a few side view mirrors and this law would have been a blessing.

Car on bike crashes are particularly dangerous and the Georgia Department of Community Health reports that there were 795 crashes across the state in 2007, including 11 that lead to deaths.

Let us just hope that the cops are diligent in writing tickets in the early going so that the concept takes root.

“Help, the insurance company is telling me that we have to file with the probate court to approve a settlement and that I as the parent don’t get any of the money as a result of my child’s injury!”
Unfortunately for cases where the gross amount of the settlement is over $25,000.00, this is true. The Georgia legislature amended the statute in 2021 to raise the threshold amount from $15,000 to $25,000. Read here for more information on injuries in a Georgia daycare.

In a tragic turn of events, two women who were horsing around at the W Hotel in Midtown Atlanta fell through the window and down 5 stories to a slanted glass sunroof. One of the women died there and the other rolled off and fell another few stories to the ground where she lay critically injured.

When a car accident case in Atlanta gets close to the trial date, your lawyers will be preparing a number of motions to limit the amount of surprises. A Motion is a document that lawyers file asking the Judge to take some particular action. In Georgia, Motions in Limine can be filed as late as the morning of trial and they are aimed at preventing the other side from using improper arguments or introducing irrelevant evidence during the trial.
